Understanding Notario Fraud

Ensuring the safety of immigrants from fraudulent individuals falsely claiming legal expertise is of utmost importance. These deceitful individuals can cause significant harm by offering inaccurate guidance, filing incorrect forms, or making false claims with the government. As a notary, you are vital in protecting immigrants from these scams.


Who Are These Fraudsters?

Fraudsters often present themselves as qualified legal advisors or experts in immigration matters, despite lacking the necessary qualifications. They routinely target and victimize members of immigrant communities. Common misrepresentations include posing as:

  • Attorneys (abogados)

  • Authorized immigration representatives

  • Legal document preparers

  • Legal assistants

  • Court license holders

  • "Notario publico" (misleadingly implying they are lawyers)


Consequences of Fraud

The impact of such fraud can be devastating for immigrants. Some of the serious consequences include:

  • Missed deadlines for important filings

  • Submission of incorrect or incomplete forms

  • Filing false claims, which can lead to deportation or legal liability

  • Significant financial losses


The "Notario Publico" Confusion

A major source of confusion stems from the term "notario publico." In the United States, a notary public is authorized only to witness signatures. However, in many Latin American and European countries, a "notario publico" is a licensed lawyer. Fraudsters exploit this difference to mislead immigrants about their qualifications, falsely implying they have legal expertise.


The Need for Awareness and Protection

This issue highlights the critical need for awareness and protection against notario fraud in immigrant communities. As a notary, you can:

  • Educate immigrants about the limited role of a notary public in the U.S.

  • Warn them about common fraudulent claims

  • Encourage them to seek advice only from qualified and licensed legal professionals
